Johannesburg - A mother of four will receive R55 000 in damages from the police after she was unlawfully arrested and locked up in a police cell overnight with her 7-month-old baby.

This followed claims she had contravened an interim protection order, which her domestic worker had obtained against her.

Queen Marumo initially claimed R153 000 in damages from the SAPS in the North Gauteng High Court in Pretoria following her ordeal on March 2, 2010.

She was arrested at her Davidsonville home, near Roodepoort, and held at the Roodepoort police station until the next day.

On the day of her arrest, her domestic worker, only identified in court papers as Lehlona, had obtained a protection order against her.

But Marumo told the court that she knew nothing about the interim protection order because it was never served on her.

Granting the damages claim, acting Judge Louis de Klerk said there was no reason to arrest her as she did not pose a threat to her domestic worker.
